1. Introduction
Greetings from InsulaAccessPoint ("us," "we," or "our"). Your access to and use of our yacht charter services and our platform, found at insulaaccesspoint.sbs, (hereafter called the "Service") managed by InsulaAccessPoint, are subject to these Terms and Conditions ("Terms").
Engaging in our charter services or using our Service implies you’ve agreed to adhere to these Terms. Should you not consent to any part of the terms here, you are not authorized to use the Service.
2. Service Overview
InsulaAccessPoint offers upscale yacht charter services which include:
- Yacht rentals for the day
- Evening voyages
- Company excursions
- Exclusive functions
- Extended sailing charters
All services are contingent upon availability and conducive weather conditions. We retain the discretionary right to alter or withdraw services at will.
3. Booking and Reservations
3.1 Booking Process
To secure a charter, the following prerequisites must be met:
- Minimum age requirement of 18
- Submission of accurate and comprehensive data
- Provision of the necessary deposit as cited in your booking confirmation
- Acceptance of these Terms and Conditions
3.2 Confirmation
A booking is considered confirmed only after payment has been made and we send you written confirmation. We maintain the right to refuse our services to any individual, based on our judgment.
3.3 Availability
Charter availability is dependent on vessel accessibility and appropriate weather conditions. We will endeavor to meet your preferred dates and hours as best as possible.
4. Payment Terms
4.1 Pricing
Quotations for all prices are in € and are inclusive of applicable taxes unless stated otherwise. Prices are adjustable and subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost, due at the time of booking
- Final payment: Required 48 hours prior to the departure of the charter
- Incidental expenses (if any): Settled upon completion of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, direct bank transfers, and certified cheques. Transactions are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Entire refund minus processing charges
- Between 24 and 72 hours before departure: 50% of the amount is refunded
- Under 24 hours before departure: No refund is issued
5.2 Weather Cancellations
If our captain determines that the weather conditions are unsafe, we will propose to either:
- Reschedule your charter at no additional charge to the next open time slot
- Issue a complete refund if there’s an inability to reschedule
5.3 Mechanical Issues
In an instance where your assigned yacht experiences mechanical failure, an effort will be made to provide an appropriate replacement. If substitution is not feasible, you will receive a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Abide by all instructions given by the crew
- Utilize safety gear as instructed
- Disclose any medical issues that could impair safety
- Stay within the yacht’s designated areas
6.2 Prohibited Items
Prohibited items on the vessel include but are not limited to:
- Glass receptacles
- Controlled substances
- Weapons or firearms
- Pets, unless given prior approval
6.3 Conduct
It is expected that all passengers behave respectfully. If behavior becomes a threat to safety or causes significant disruption, we retain the right to terminate the charter early without a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the sum you’ve paid for your charter. We bear no responsibility for:
- Injuries incurred through personal negligence
- Loss or destruction of personal belongings
- Indirect, consequential, or punitive damage claims
- Delays stemming from weather or events beyond our control
7.2 Insurance Coverage
We keep comprehensive marine insurance for our fleet and operations. However, passengers are in charge of their travel and personal insurance provisions.
7.3 Assumption of Risk
By participating in our yachting services, you are recognizing and assuming the inherent risks involved in such marine activities and take personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
We reserve the discretionary authority to adjust itineraries, travel routes, or schedules subject to considerations like weather, safety, or operational necessities. We will strive to provide equivalent alternative experiences.
9. Force Majeure
We shall not be held accountable for any delays, termination, or amendments caused by events that are outside of our control, including:
- Extreme weather conditions
- Natural calamities
- Regulatory impositions
- Closure of harbors
- Mechanical failures
10. Privacy and Data Protection
Your personal details are managed in accordance to our Privacy Policy. By utilizing our Service, you grant consent for the collection and use of your information following the guidelines of our Privacy Policy.
11. Intellectual Property
Our website's content, including text, graphics, logos, images, is safeguarded by copyright and trademark laws. Any redistribution, reproduction, or creation of derivative works require our explicit written approval.
12. Governing Law
The governing laws of Monaco dictate the interpretation of these Terms. Any disputes will be settled in the courts located in Monte Carlo, Monaco.
13. Changes to Terms
We retain the right to adjust these Terms when necessary. Modifications will be reflected on our website with an updated date of revision. Your continued use of our services represents an endorsement of the altered terms.
